1. Who we are
Echo (the "Service") is operated by Marie Lorraine Gerard Services ("we", "us", "our"). By using the Service you ("you") enter into a binding agreement with Marie Lorraine Gerard Services.
2. Acceptance
By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
3. The Service
Echo is an AI-assisted tool that helps you draft on-brand social posts and comments for platforms such as X, LinkedIn, and Substack. You are responsible for everything you publish using outputs from the Service.
4. Eligibility & account
You must be of legal age in your jurisdiction. You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account.
5. Acceptable use
You must not misuse the Service. In particular, you must not:
- Use the Service unlawfully or to facilitate fraud, spam, harassment, deepfakes, hate speech, or other harmful content.
- Infringe the intellectual property or privacy of others.
- Probe, scan, scrape, reverse engineer, or otherwise interfere with the security or integrity of the Service.
- Attempt to jailbreak or circumvent safety, rate, or quota limits.
- Resell or redistribute the Service without our written consent.
6. AI outputs & your content
Generative AI can produce inaccurate, biased, or offensive output. You are responsible for reviewing outputs before publishing them and for ensuring you hold the necessary rights to any input content you submit. As between you and us, you retain ownership of your inputs and outputs. You grant us a limited license to host and process your content solely to provide the Service. We may remove content, refuse outputs, or suspend accounts to enforce these Terms or applicable law. Repeat infringers may be terminated.
7. Intellectual property
The Service, including its software, models, branding, and documentation, is owned by Marie Lorraine Gerard Services and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
8. Payments, subscriptions & taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, currency conversion, cancellations, and refund mechanics are governed by the Paddle Checkout Buyer Terms.
Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel anytime from your billing page; access continues until the end of the paid period.
9. Service level
We do our best to keep the Service available, but we do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and we disclaim all implied warranties to the fullest extent permitted by law.
10. Suspension & termination
We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination, your right to use the Service ends; we may delete your data after a reasonable export window.
11. Liability
To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.
12. Indemnity
You will indemnify us against claims arising from your content, your use of outputs, or your breach of these Terms.
13. Changes
We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws applicable at the seat of Marie Lorraine Gerard Services, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction.
